Israel E-2 Treaty Investor Visa Officially Approved

The U.S. Embassy in Israel has confirmed it will begin processing E-2 visas for Israeli citizens – effective May 1, 2019. Israeli citizens are advised to apply for an E2 visa at the U.S. Embassy Branch Office in Tel Aviv.

The E2 visa announcement is the outcome of years of negotiations between the United States and Israel.  It is exciting news for Israeli businesses seeking an entry into the U.S. market. Israel has a technologically advanced market economy. Cut diamonds, IT services, high technology medical equipment, and pharmaceuticals are among leading exports.

The E2 visa will allow Israelis to invest in opening a U.S. business. An E2 visa will also allow the business owner (and select top talent employees) to live in the United States to direct, develop and manage their investment.

View the U.S. Department of State’s Treaty Countries for a current list of countries with which the United States maintains a treaty of commerce and navigation.

The United States Citizenship and Immigration Services (USCIS) requires that an E2 treaty investor must show at least 50 percent ownership of the enterprise; or possession of operational control through a managerial position or other corporate device.

The enterprise must have the present or future capacity to generate more than enough income to provide a minimal living for the treaty investor and their family. See 4 Tips to Know About E2 Visa Marginality Requirements.

The treaty investor must risk a substantial amount of capital with the objective of generating a profit.

The E-2 visa is a relatively fast entry into the U.S. by allowing applicants to apply directly with a consulate abroad.

The E2 treaty investor visa program will make it easier for Israeli companies, especially start-ups, to establish businesses in the U.S. Many technology companies, multinational businesses, real estate investment firms and startups have made use of the E-2 visa to bring a business presence to the U.S.

4. Provide Evidence for Income Generation: An E2 applicant is to provide evidence that the enterprise will generate significant income at a level that is above a standard living income for the total number of family members in the investor’s household.

5. Provide Documentation for Source of E2 Visa Investment: If the enterprise has the capacity to generate significant income then the investor should provide evidence. For example, if the enterprise has already generated high sales volume, then the investor should provide bank statements and Profit & Loss statements to support the declaration of high income.
