Termination of Honduras TPS Program

US Visas for Business,VERDIN Dallas E2 Visas,VERDIN Dallas Immigration Attorney,VERDIN E2 Visa Attorney,VERDIN Immigration Law PlanoThe termination of the TPS program for citizens of Honduras has been announced. Honduran citizens who own a United States business have an option: the E-2 Visa.

The E-2 Visa is for foreign nationals who start and/or own a business in the United States. The time to act is now.

The official TPS Termination announcement specified Jan 5, 2020 as the Honduras TPS expiration date. “To allow for an orderly transition….determined to delay the effective date of the termination for 18 months. The designation will terminate on January 5, 2020.”

Steps for Citizens of Honduras to Get an E-2 Business Visa

1. First, request Advance Parole from USCIS to travel to Honduras and to seek an E2 Visa interview.
2. To receive the Advance Parole for travel to Honduras, the Honduran national would present evidence that they have invested capital into a US business.
3. With the Advance Parole, the Honduran national would travel to Honduras to seek an E2 Visa interview at a US Embassy in Honduras.
4. With the E2 Visa, the Honduran national would re-enter the United States with an E-2 Visa.
5. Spouses and children under 18 would be eligible to apply for an E2 Visa as Dependents.
6. Get assistance from an attorney Board Certified in Immigration Law.

E2 Visa Overview

The E2 Visa is a non-immigrant visa which allows foreign nationals to start businesses in the U.S.

The E2 Visa requires that the foreign entrepreneur invest business capital in the U.S. to start up a new venture; or to acquire an existing business venture.

In exchange for the capital investment, the U.S. government will issue an E2 Visa; once all other requirements are met.

E2 Visa Points to Know

  1. Plan to Succeed: The U.S. government wants to see that the foreign investor has planned for success. Accordingly, the investor should provide a detailed 5-year business plan – forecasting capacity to generate sufficient revenue to exceed minimal living standards.

  3. Create US Job Opportunities: The foreign investor should provide evidence to show that the enterprise will create job opportunities in the U.S. By expanding jobs in the U.S. economy, the investor can increase his or her probabilities of obtaining the E2 visa.
  4. Provide Evidence for Income Generation: An E2 applicant is to provide evidence that the enterprise will generate significant income at a level that is above a standard living income for the total number of family members in the investor’s household.
  5. Provide Documentation for Source of E2 Visa Investment: If the enterprise has the capacity to generate significant income then the investor should provide evidence. For example, if the enterprise has already generated high sales volume, then the investor should provide bank statements and Profit & Loss statements to support the declaration of high income. We advise on all strategies and tools available, such as VIBE; a free tool the U.S. government uses this tool to investigate businesses.

ALERT: On May 4, 2018, Secretary of Homeland Security Kirstjen M. Nielsen announced her decision to terminate the Temporary Protected Status (TPS) designation for Honduras with a delayed effective date of 18 months to allow for an orderly transition before the designation terminates on Jan. 5, 2020.
